Terms of Service
These Terms of Service ("Terms") govern your use of the mobile applications and related services operated by Orchard Hill Holdings, LLC ("we," "us," or "our"), including Reprz (collectively, the "Services"). By using the Services, you agree to these Terms.
1. Eligibility and Accounts
You must be at least 13 years old (or the equivalent minimum age in your jurisdiction) to use the Services. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Provide accurate information and keep it up to date.
2. Not Medical Advice
The Services provide general fitness and training information, including AI-generated coaching suggestions. The Services are not medical advice and are not a substitute for professional medical care. Consult a physician before beginning any exercise program, especially if you have a medical condition. You use the Services and perform any exercise at your own risk.
3. Subscriptions and Purchases
Some features may require a paid subscription. Subscriptions purchased through the Apple App Store or Google Play are billed and managed by Apple or Google under their terms. Unless required by law, payments are non-refundable; refund requests for App Store and Google Play purchases are handled by Apple and Google under their respective policies. Subscription terms and pricing are presented in the app at the time of purchase.
4. Acceptable Use
You agree not to:
- Use the Services for any unlawful purpose;
- Attempt to gain unauthorized access to the Services or other users' accounts;
- Interfere with or disrupt the Services, including by introducing malware or placing unreasonable load on our infrastructure;
- Reverse engineer, decompile, or scrape the Services except as permitted by law;
- Resell or commercially exploit the Services without our written permission.
5. Your Content
You retain ownership of the data and content you submit to the Services (such as workout logs and profile information). You grant us a limited license to host, process, and display that content as needed to operate and improve the Services, consistent with our Privacy Policy.
6. Intellectual Property
The Services, including all software, design, text, and graphics (excluding your content), are owned by Orchard Hill Holdings, LLC or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Services for personal, non-commercial purposes.
7. Termination
You may stop using the Services and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Services. Sections that by their nature should survive termination will survive.
8. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ORCHARD HILL HOLDINGS, LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.
10. Governing Law
These Terms are governed by the laws of the State of Wyoming, without regard to its conflict of laws principles. Any disputes will be resolved in the state or federal courts located in the State of Wyoming.
11. Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date above. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
